1. Who we are and what this policy covers

PersonifyUSA.com (“we”, “us”, “our”) publishes information about Personify Financial's personal loans and operates a request form that connects people who want to borrow $200 to $5,000 with lenders and lending partners. We are not a lender, and we are not owned by, affiliated with or operated by Personify.

This Privacy Policy explains what personal information we collect through this website, how we use it, who we share it with and the choices you have. It applies to this website only. Lenders and other third parties you deal with have their own privacy policies, which govern what they do with your information.

2. Information we collect

Information you give us

When you use our request form or application, we collect the details you enter. Depending on how far you go, this can include:

• Request details: the amount you want, the purpose, your state, your credit profile and your source of income.
• Contact details: name, postal address, email address and telephone number.
• Identity details: date of birth, Social Security number, and driver's licence or state ID number.
• Financial details: employer, income, pay frequency, housing status, and bank account and routing numbers.
• Messages: anything you send us by email.

You can read every page of this website without giving us any of this. We ask for it only when you choose to send a request.

Information collected automatically

Like most websites, we and our service providers automatically receive your IP address, device and browser type, approximate location derived from your IP address, the pages you view, the links you click, the page that referred you, and the date and time of your visit. We collect this using cookies and similar technologies, described in section 5.

Information from others

We may receive information about you from lenders and lending partners (for example, whether a request was accepted), from identity-verification and fraud-prevention services, and from advertising and analytics providers.

Tools that do not collect anything

The loan calculator, the readiness checklist and the state search on this website run entirely in your browser. What you type into them is not sent to us or stored.

3. How we use your information

• To pass your request to lenders and lending partners so that they can decide whether to make you an offer.
• To verify your identity and to detect and prevent fraud.
• To contact you about your request, and to answer your questions.
• To send you marketing about financial products, where the law allows it and you have not opted out.
• To operate, secure, analyse and improve this website.
• To comply with the law, respond to lawful requests, and establish or defend legal claims.

We do not make lending decisions. Lenders make those decisions using their own criteria.

4. How we share your information

This is the most important section of this policy. The purpose of our request form is to share your information with third parties who may be able to offer you a loan.

• Lenders and lending partners. When you submit a request, we share the information in it, including sensitive details such as your Social Security number and bank account information where you have provided them, with one or more lenders, lender networks and other lending partners. They may use it to evaluate your request, verify your identity, check your credit and contact you. We may receive compensation from them.
• Other marketing partners. If no lender can help, or in addition to a lender match, we may share your contact details and request details with providers of related financial products and services, such as credit repair, debt relief or credit monitoring, who may contact you with offers.
• Service providers. Companies that host this website, process and route requests, verify identities, prevent fraud, deliver emails and messages, and provide analytics, acting on our instructions.
• Legal and safety. Regulators, courts, law enforcement and others where we believe disclosure is required by law or needed to protect rights, property or safety.
• Business transfers. A buyer or successor if this website or its business is sold, merged or reorganised.

Once a lender or partner receives your information, its own privacy policy applies. If you want it to stop contacting you, you will need to tell it directly.

5. Cookies and similar technologies

We use cookies, pixels and local storage to keep the website working, remember your preferences, measure how the site is used, attribute requests to the advertising that produced them, and show or measure advertising. Some of these are set by third-party analytics and advertising providers.

You can block or delete cookies in your browser settings. If you do, parts of the website may not work properly. Browsers send different “Do Not Track” signals and there is no agreed standard for them, so this website does not respond to them. Where required by law, we honour recognised opt-out preference signals such as Global Privacy Control for the browser that sends them.

6. Calls, texts and emails

When you submit a request you are asked to give your consent to be contacted about it. With that consent, we, and the lenders and partners who receive your request, may contact you at the telephone number and email address you provided, including by automated telephone dialling systems, artificial or pre-recorded voice messages and text messages. Message and data rates may apply. Your consent is not a condition of obtaining a loan or any other product.

You can withdraw consent at any time. Reply STOP to a text message, use the unsubscribe link in an email, or tell the caller you no longer wish to be contacted. To stop contact from us, email [email protected]. To stop contact from a lender or partner, contact that company directly.

7. Your choices

• Do not submit a request. All the information on this website is available without one.
• Opt out of marketing. Use the unsubscribe link in any marketing email, or email us.
• Opt out of the sale or sharing of your personal information. Email [email protected] with the subject line “Do Not Sell or Share” and the email address and telephone number you used. We will stop selling or sharing your information from that point on. We cannot recall information that has already been passed to a lender or partner, but we will tell you who received it if you ask.
• Ask what we hold, correct it or delete it. Email us as described in section 8.

8. Your privacy rights under state law

Residents of California, Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, Virginia and other states with comprehensive privacy laws have some or all of the following rights, subject to exceptions:

• to know what personal information we have collected about you, and to receive a copy;
• to correct inaccurate personal information;
• to delete personal information we collected from you;

How to make a request. Email [email protected] from the email address you used with us, tell us which right you want to exercise and the state you live in. We will confirm your identity by matching details you have already given us, and we may ask for more if needed. An authorised agent may act for you with your written permission. We respond within the period the law requires, normally 45 days. If we decline your request, you may appeal by replying to our decision, and you may contact your state attorney general if you remain dissatisfied.

In the past 12 months we have collected the following categories of personal information, from the sources and for the purposes described above:

We keep each category for the period described in section 10. We do not knowingly sell or share the personal information of anyone under 18. Some financial information is subject to federal law, including the Gramm-Leach-Bliley Act, and may be exempt from parts of state privacy law.

California's “Shine the Light” law lets residents ask once a year which categories of personal information we disclosed to third parties for their direct marketing. Email us to make that request.

9. How we protect your information

We use administrative, technical and physical safeguards designed to protect personal information, including encryption of data in transit, restricted access and monitoring of our systems. No website or method of transmission is completely secure, and we cannot guarantee absolute security. Please do not send Social Security numbers, bank details or other sensitive information to us by email.

10. How long we keep it

We keep personal information for as long as we need it for the purposes described in this policy, including to meet legal, accounting and record-keeping obligations, to resolve disputes and to demonstrate the consent you gave. Request records are typically kept for up to five years. After that we delete the information or remove the details that identify you.

11. Children

This website is for adults. We do not knowingly collect personal information from anyone under 18. If you believe a child has given us information, email us and we will delete it.

12. Links to other websites

This website links to lenders, review platforms, government resources and other third-party sites. We do not control them and are not responsible for their content or privacy practices. Read the privacy policy of any site before you give it your information.

13. Changes to this policy

We may update this policy from time to time. When we do, we change the effective date at the top of this page. If a change significantly affects how we use information we already hold, we will take reasonable steps to let you know. Your continued use of the website after a change means the updated policy applies.
