1. Your agreement with us

These Terms of Use (“Terms”) are an agreement between you and PersonifyUSA.com (“we”, “us”, “our”). They apply to your use of this website and every tool and form on it. By using the website you accept these Terms and our Privacy Policy and Disclaimer. If you do not agree, please do not use the website.

2. Who can use this website

You may use the request form only if you are at least 18 years old (or the age of majority where you live, if higher), a resident of the United States, and able to enter into a binding contract. You may read the rest of the website from anywhere.

3. What we do, and what we do not do

• We are not a lender. We do not make loans or credit decisions, set rates or terms, or collect payments.
• We are not Personify. This website is not owned by, affiliated with or operated by Personify Financial. Information about Personify's products is provided for reference and comes from its public disclosures.
• We connect. If you submit a request, we pass it to lenders and lending partners who may choose to make you an offer.
• We guarantee nothing. We do not promise that you will be matched with a lender, approved, or offered any particular amount, rate or term. Not all lenders operate in all states.
• We charge you nothing. There is no fee to use this website or to submit a request. Lenders and partners may pay us, as explained in our Disclaimer.

Any loan is a contract between you and the lender alone. Read the lender's agreement and disclosures carefully before you accept. You are never obliged to accept an offer.

4. When you submit a request

By submitting a request you:

• confirm that the information you give is true, accurate, complete and your own;
• instruct and authorise us to share that information with lenders, lender networks and other partners, as described in the Privacy Policy;
• authorise those lenders and partners to verify your information and to obtain consumer reports about you from consumer reporting agencies, which may include credit bureaus and specialised agencies, and which may affect your credit score; and
• understand that submitting false information may be a crime and will result in your request being rejected.

5. Consent to be contacted

When you submit a request you are asked for your express written consent to be contacted about it. If you give it, you agree that we, and the lenders and partners who receive your request, may contact you at the number and email address you provided, including through automated telephone dialling systems, artificial or pre-recorded voices and text messages, even if your number is on a Do Not Call list. Message and data rates may apply. Consent is not a condition of any purchase or loan. You may withdraw it at any time, as described in the Privacy Policy.

6. Electronic communications

You agree that we may provide notices, disclosures and other communications to you electronically, by email or by posting them on this website, and that electronic communications satisfy any legal requirement that a communication be in writing. To receive them you need a device with internet access, a current browser and a working email address. You may withdraw this consent by emailing us, but we will then be unable to process a request for you.

7. Information and tools are not advice

The articles, comparisons, ratings summaries and calculators on this website are general information. They are not financial, legal or tax advice, and they are not an offer or a commitment to lend. Calculator results are estimates based on the numbers you enter and on stated assumptions. Rates, fees, terms and availability change, and figures for third-party lenders come from public sources that we do not control. Check current terms with the lender before you decide.

8. Acceptable use

You agree not to:

• submit information that is false or that belongs to someone else;
• use the website for any unlawful or fraudulent purpose;
• copy, scrape, harvest or republish content or data from the website by automated means without our written permission;
• interfere with the website's security or operation, or attempt to gain unauthorised access to it; or
• use the website to send unsolicited communications.

9. Ownership and trademarks

The text, design, graphics, code and other content of this website belong to us or our licensors and are protected by copyright and other laws. You may view and print pages for your personal, non-commercial use. No other use is permitted without our written consent.

“Personify” and “Personify Financial” are trademarks of their owner. Other company and product names on this website, including the names of lenders and review platforms, are trademarks of their respective owners. We use them only to identify those companies and their products. Their use does not imply any affiliation with, or endorsement of, PersonifyUSA.com.

10. Third-party websites and services

This website links to, and may pass you to, websites and services operated by others, including lenders. We do not control them, and we are not responsible for their content, products, decisions, terms or privacy practices. Your dealings with them are between you and them.

11. No warranties

This website is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the website will be uninterrupted, secure or error-free, or that any information on it is complete or current.

12. Limit on our liability

To the fullest extent the law allows, we and our owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the website or from any loan or other product you obtain from a third party. Our total liability for any claim relating to the website will not exceed one hundred US dollars ($100). Some states do not allow certain limitations, so parts of this section may not apply to you.

We may suspend or end access to the website, or to any part of it, at any time. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, with the Privacy Policy and the Disclaimer, are the entire agreement between you and us about the website.
